Introduction

This website/mobile application www.ssbeauty.in and this Chabot (collectively “Platform” and/or “App”) is owned and operated by Shoppers Stop Limited ('Shoppers Stop', ‘SSL’, 'SSBeauty', 'we' or 'us') having its registered office at Umang Tower, 5th Floor, Mindspace, Off. Link Road, Malad (West), Mumbai, Maharashtra – 400 064. SSBeauty carries out its business from its retail stores (under the brand SSBeauty) and website and mobile application “ssbeauty.in”.

In subscribing, accessing or using the Platform or any services, functionality or offers therein, you are deemed to have read, understood and accepted to be bound by the Privacy Policy and terms and conditions of the agreement listed below (“Terms & Conditions”), or as may be revised from time to time, and you understand and agree that you are bound by such terms till the time you continue to use and access this Platform. IF YOU DO NOT WANT TO BE BOUND BY THE TERMS & CONDITIONS, YOU MUST NOT SUBSCRIBE TO OR USE OUR SERVICES. This document is an electronic record in terms of Information Technology Act, 2000 & rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the Platform (“User Agreement”).

Terms & Conditions

Please read the terms and conditions herein very carefully. The terms and conditions herein along with the Privacy Policy, govern your subscribing, accessing or using the Platform or any services, functionality or offers therein (“Services”). The Privacy Policy and the Terms & Conditions and any other policies or guidelines that may be applicable to the Platform at the time of your accessing and using the Platforms, as updated, shall constitute the complete agreement of SSBeauty with you.

We may from time to time, at our sole discretion and without assigning any reason, modify the Terms & Conditions. Please check the Terms & Conditions carefully every time you access the Platform for availing the Services.

By subscribing, accessing or using the Platform or any Services, you are deemed to have read, understood and accepted to be bound by the Terms & Conditions or as may be revised from time to time, and you understand and agree that you are bound by such terms till the time you continue to use and access this Platform.

Eligibility to Use

Use of the Platform is available only to persons who are legally competent to contract in accordance with under applicable law. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform. If the customer/ your age is below 18 years, you are prohibited from using/purchasing/contracting with, through or under this Platform. Such persons are also prohibited from purchasing any material which is for adult consumption, the sale or purchase of which to/by minors are strictly prohibited. SSBeauty reserves the right to terminate your membership forthwith without any notice and to refuse to provide you with access to the Platform if SSBeauty discovers that you are under the age of 18 years. The Platform is not available to persons whose membership has been suspended or terminated by SSBeauty for any reason whatsoever. If you are registering as a business entity, you represent that you have the authority to bind the entity to this User Agreement. Unless otherwise specified, the Platform is directed solely t, and the materials on this Platform, are directed solely at those who access this Platform from India. SSBeauty makes no representation that any products or services referred to in the materials on this Platform are appropriate for use, or available outside India. Those who choose to access this Platform from outside India are responsible for compliance with local laws if and to the extent local laws are applicable. SSBeauty will deliver the products only within India and will not be liable for any claims relating to any products ordered from outside India. Some Indian states may prohibit direct sale of merchandise from other states and require special documentation to effect such a sale without dual taxation, if SSBeauty receives an order from such states or to be delivered to such states (to see a list please refer our shipping policy), under such circumstances SSBeauty retains the right to accept or reject the order. Those who choose to access this Platform from Indian states which restrict such use are responsible for compliance with local laws, if and to the extent, local state laws are applicable. SSBeauty will deliver the products only within states having an open import policy and will not be liable for any claims relating to any products ordered from restricted states. Except where additional terms and conditions are provided which are product specific, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted.

You may register yourself before placing an order by providing “Your Information”. Customers opting for guest checkout will be automatically registered once an order is successfully placed.

“Your Information” is defined to mean and include any information you provide to us in the registration, buying or listing process, in the feedback area or through any e-mail feature or a written letter or form mailed or submitted to any of our stores and offices. We will protect Your Information in accordance with our Privacy Policy. If you use the Platform, you are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. SSBeauty shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. If you know or suspect that someone else knows your password or suspect any unauthorised use of your password you should notify us by contacting us immediately through the address provided in the beginning of this User Agreement. If SSBeauty has reason to believe that there is likely to be a breach of security or misuse of the Platform, we may require you to change your password or we may suspend your account without any liability to SSBeauty. Please note that any information, materials, suggestions, ideas or comments sent to SSBeauty will be deemed non-confidential. By submitting any such information, you are granting SSBeauty an irrevocable and unrestricted license to use, modify, reproduce, transmit, display and distribute such materials, information, suggestions, ideas or comments for any purpose whatsoever. However, we will not use your name in connection with any such materials, information, suggestions, and ideas or comments unless we first obtain your permission or otherwise are required by law to do so.

Ownership of Rights

All rights, including copyright, in this Platform are owned by or licensed to SSBeauty. Any use of this Platform or its contents, including copying or storing it or them in whole or part, other than for the personal, non- commercial use of customer is prohibited without the permission of SSBeauty. The customer shall not be entitled to and shall not modify, distribute or re-post something on this Platform for any purpose.

Accuracy of Content and Invitation to Offer

SSBeauty has taken every care in the preparation of the content of this Platform, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. All prices are displayed inclusive of GST. Packaging may vary from that shown. The weights, dimensions and capacities given are approximate only. SSBeauty has made every effort to display as accurately as possible the colours of our products that appear on the Platform. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. To the extent permitted by applicable law, SSBeauty disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this Platform. SSBeauty shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this Platform.

All products/services and information displayed on Platform constitute an invitation to offer. Your order for purchase constitutes your offer which shall be subject to the Terms & Conditions as listed herein. SSBeauty reserves the right to accept or reject your offer in part or in full. Our acceptance of your order will take place upon dispatch of the product(s) ordered. Dispatch of all the product(s) ordered, may or may not happen at the same time; if this takes place then such portion of the order which has been dispatched will be deemed to have been accepted by SSBeauty and the balance would continue to be on offer to SSBeauty, and SSBeauty reserves the right to accept or reject such balance order.

No act or omission of SSBeauty prior to the actual dispatch of the product (s) ordered will constitute acceptance of your offer. If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm dispatch and thereafter acceptance of the order.

You also agree and confirm:

• To provide true, accurate, current and complete information about yourself as prompted by SSBeauty registration form or guest details form (such information being the "Registration Data").
• To maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, incomplete, or not current or if SSBeauty has reasonable grounds to suspect that such information is untrue, inaccurate, and not current or not in accordance with the User Agreement, SSBeauty has the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Platform.
• That in the event that a non- delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by SSBeauty for redelivery shall be claimed from you and you shall pay such costs.
• That you will use the services provided by SSBeauty, its affiliates, consultants and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using the Platform and transacting on the Platform.
• You will provide authentic and true information in all instances where such information is requested of you. SSBeauty reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), SSBeauty has the right in its sole discretion to reject the registration and debar you from using the Services of SSBeauty and or other affiliated Platform without prior intimation whatsoever.
• That you are accessing the services available on this Platform and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Platform.
• That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.
• That before placing an order you will check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale and invitation of offer included in the item's description.

Usage Restrictions

You shall not use the Platform for any of the following purposes:

• Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material;
• Transmitting material that encourages conduct that constitutes a criminal offence and/or results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
• Gaining unauthorised access to other computer systems.
• Interfering with any other person's use or enjoyment of the Platform.
• Breaching any applicable laws;
• Interfering or disrupting networks or Platform connected to the Platform.
• Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

Payment Terms

• You agree to pay the price applicable for the product or service on the Platform, for shopping at the time you submitted your order.
• All payments are non-refundable (except as expressly set forth in the Terms & Conditions).
• Copy of the PAN Card needs to be mandatorily submitted for the below transactions:

Terms & Conditions for Cash-On-Delivery (COD)

• Unless specify with higher value against specific merchandise, there is no minimum order value for cash on delivery. We retain our right to specify the minimum order value at any time at our sole discretion.
• The maximum order value for cash on delivery is Rs.5000/- (Rupees five thousand only).
• In order to opt the option of COD you need to select “Cash On Delivery” option on the payment page.
• COD option may not be available for all serviceable pin codes. You are advised to check the serviceability of the PINCODE before placing the order on the Product Description Page under Delivery Service tab.
• Save and except for delivery charges as applicable for all orders, there are no additional delivery charges for COD option.
• COD payment option cannot be clubbed with any other prepaid payment mode.
• COD option on the payment page may differ from customer to customer basis certain checks & criterions at our end.
• To accept all COD orders, a customer has to make payment to the courier person at the time of delivery before accepting and opening the parcel
• Customer may opt to pay the eligible COD amount through cash or digital mode of payment. The Option for digital mode of payment would be available only if the delivery partner accepts the same. For more payment options, please check with the courier executive at the time of delivery.
• Gift card, Gift voucher, E-Gift card, First Citizen membership, products with warranty cards, high value products cannot be purchased through COD as a payment option.
• SSBeauty at its sole discretion, without assigning any reason, reserves the right to disable COD option for account users and customers that may have high number of returns and a high number of shipment refusals.

Quantity restrictions

SSBeauty reserves the right, at its sole discretion, to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, user name/ email id, the same credit / debit card, and to orders that use the same billing and/or shipping address. We will provide a notification to the customer, should such limits be applied. SSBeauty also reserves the right, at its sole discretion, to prohibit sales to any person as it may deem fit. However, in some cases where the order quantities are large, SSBeauty may verify for security purposes, to confirm that such items have been ordered.

Colors / Exactness not guaranteed

Our best effort is to display the colors of the products as accurate as possible. However, colors may appear slightly different on digital devices.

The images shown on the product page may appear slightly different from the actual product, as the images displayed on www.ssbeauty.in or M-site or SSBeauty App (i.e. Platform) are for visual representation only. The product image and colour is highly dependable on the resolution of the device that you are using and many vary from one device to another.

SSBeauty hereby disclaims any guarantees of exactness as to the finish and appearance of the final Product as ordered by the user.

GST

Price on the Platform will be inclusive of GST.

Cancellation by the customer

You may cancel your order before we bill and ship the products to you.

You may opt to cancel the order by yourself by logging into your SSBeauty App or website or M-site (i.e. Platform) under My Account > Cancel Order by selecting the order you want to cancel.

If some products in your order or an entire order is billed, the option of “Cancel order” will be disabled and will not allow you to cancel to order.

In case you wish to or we receive a cancellation request after billing or after the products have been shipped, we will send a cancelation request to our stores/warehouse/vendor, asking them not to dispatch the products and arrange for a refund accordingly.

However, in the interim, if the product has already been handed over to our courier partner and is in transit or out for delivery, we request you to refuse the delivery of your order. The refund for the refused order will be initiated once the products come back to our store/warehouse.

The refund of prepaid orders will be processed to the same payment mode that was used while placing the order. The refund for Cash-on-Delivery (COD) orders is not applicable in case of cancellation.

Orders placed for purchase of First Citizen Membership, Gift vouchers or E-Gift vouchers cannot be cancelled or returned.

The discount coupon code, discount voucher or any promotional offer used at the time of purchase is non-refundable in case of cancelation.

Cancellation by SSBeauty

While we work hard to fulfil your order to the best of our ability, there may be a possibility that while procuring the product from our stores/warehouse/vendor the product may be out of stock or not in saleable condition. In such situations, if we are unable to process your order either partially or completely, we shall cancel the order for such products, refund all payments made for the cancelled products, and send an email informing you about the same.

The refund of prepaid orders will be processed to the same payment mode that was used while placing the order. The refund for Cash-on-Delivery (COD) orders is not applicable in case of cancellation.

The discount coupon code, discount voucher or any promotional offer used at the time of purchase is non-refundable in case of cancelation.

Cancelation In Case Of Mispricing

SSBeauty strives to provide accurate product information and pricing information on the Platform, pricing or typographical or miss-priced errors may occur. Despite our best efforts, a small number of products in our extensive catalogue may get mispriced. However, we verify prices as part of our dispatch procedures. If the correct price of the product is lower than our stated price, we shall process a refund of the price difference and send you the product. If a product's correct price is higher than our stated price, we may cancel your order and notify you about the cancellation. SSBeauty decision in this regards, shall be final and binding

The refund of prepaid orders will be processed to the same payment mode that was used while placing the order. The refund for Cash-on-Delivery (COD) orders is not applicable in case of cancellation.

Cancellation of Fraudulent Orders

To provide a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. In the event of detecting any suspicious activity, SSBeauty reserves the right to cancel orders at any stage of the order journey and future orders without any liability and/or without assigning any reason to cancellation. SSBeauty also reserves the right to refuse or cancel orders in scenarios like inaccuracies in pricing of product on Platform, stock unavailability, multiple orders placed for the same product with the same delivery address, orders placed for multiple quantities for the same product, invalid delivery address/PIN code, orders placed through technical glitch/loophole or orders placed via malpractice. We may also require additional verifications or information before accepting any order. If your order is cancelled, then the amount will be refunded back to the same payment mode that was used while placing the order. The refund for Cash-on-Delivery (COD) orders is not applicable in case of cancellation.

The discount coupon code, discount voucher or any promotional offer used at the time of purchase is non-refundable in case of cancelation.

In the event where your order gets cancelled, you would be intimated through a sms and email communication.

Return & Exchange

We at SSBeauty take full responsibility that the products sold by us are 100% genuine and fresh. We have an easy 15 day Return/Exchange Policy, under which you may return / exchange products purchased received by you (subject to the terms and conditions specified below) is :

• Close to expiry; if the expiry date on the product is ≤6 months
• An expired product has been received
• A damaged product has been received
• A defective product has been received
• There is a price mismatch; the billed amount vs price on the physical product received is different
• The wrong product has been received

We are currently accepting the products for refunds only. The Exchange request feature will be available soon.

Other terms and conditions for return/exchange of products:

• Returns and exchanges are allowed provided the product is in its original condition i.e., unused, unopened, untampered and in saleable condition with original tags, invoice and original intact packaging.
• Customers can raise a return/exchange request by going to the Profile > My Orders section on the app or the web or by calling Customer Care on 1800 210 4555 or write to us at customercare@ssbeauty.in
• While raising the return/exchange request, it is mandatory for the customer to share the image of the product and packaging clearly depicting the product, price tag and picture showing reason for return/exchange.
• All return products received at our warehouse/SSBeauty or Shoppers Stop stores will undergo a quality check. If the product picked up for return/exchange does not pass the quality check, then the refund/exchange will be put on hold, and we shall ship the product back to you.
• Please note that all exchanges are subject to stock availability.
• We do not accept any return/exchange for First Citizen Cards, Gift Vouchers, Gift Cards and E-Gift Vouchers

You may return/exchange products in the following ways:

If you request a return or exchange through SSBeauty courier collection for any reason within the specified days as mentioned above, you must return the product in an original condition (unused, unopened, untampered and in saleable condition) with original tags, invoice and original, original & intact packaging, failing which a return/exchange may not be possible.

You may raise Return or Exchange by login into your SSBeauty account from Account > Orders > Return/Exchange

Alternatively, you may write to us at customercare@ssbeauty.in and request a return or exchange.

We request you to take utmost care in selecting the refund mode while raising a return request as a refund mode once selected cannot be changed or modified.

The courier executive will pick the product within two working days from the date the request is raised. You will receive a SMS confirmation or physical receipt at the time the product is picked up. We request you to retain these details until your request is complete.

If you wish to return or exchange any product by yourself, you may return it in an unused, original condition with original tags and original packaging (along with boxes if any) within the specified days from the date of delivery as mentioned above. The courier cost will be borne by the customer. We shall not reimburse the shipping cost.

However, in rare situations, if we do not service pick-up at your location, we may request you to ship the product back to us provided product is in original condition, unused, original price tag and within the timeframe of 15 days of Return/Exchange period policy. In such case, we will credit the shipping cost in the form Shoppers Stop credits upon receipt of the scan copy of the courier slip.

In either of the above Return/Exchange courier collection, will undergo a quality check after the product has been received at our warehouse/the Shoppers Stop Store. If the product collected does not pass the quality check, we shall ship it back to you.

We may take approximately 7-10 working days to complete your request.

For returns, the refund is initiated as per the refund mode selected at the time of raising the request.

A refund for eligible cash-on-delivery orders will be done through online transfers to the bank account as per the details submitted by you at the time of initiating the return. We request you to take utmost care while submitting the bank details to ensure the correct details are shared. You shall receive the credit into your account within 2-3 working days from the day the refund is processed.

The credit reflection totally depends on the timeline specified by the bank. In the case of nationalized banks, you may expect a further delay for credit reflection in your account.

Any First Citizen points which are accumulated at the time of purchase will be reversed if such merchandise on which points were earned, is returned.

For exchange requests, the order placement is subject to stock availability. Once, the exchange order is generated, you will be informed about the order through a separate detailed email.

Most items are returnable in our stores. You may visit any SSBeauty or Shoppers Stop store in India and return the merchandise in an original condition (unused, unopened, unwashed, unaltered, untampered and in saleable condition) with original tags, invoice and original packaging intact.

If returned at store, You will be issued a credit note against receipt of the product, regardless of whether the payment for the original purchase was made by Net Banking, UPI, Wallets, Debit/Credit Card, Gift Cards, E-Gift Voucher, First Citizen Points or through any other means.

You may redeem the credit note against any purchase of an equivalent amount from any SSBeauty or Shoppers Stop stores within six months.

You cannot redeem credit note against the purchase of Gift card, E-Gift voucher or First Citizen Card.

SSBeauty is a beauty destination offering leading International and national brands across India.

We service most of the PIN codes for delivery within India through our various courier partners’ robust logistics network. The serviceable location might differ for Prepaid & Cash on Delivery Orders. We do not deliver products outside India.

A customer might check the serviceability of the PINCODE before placing an order on the Product Description Page under the Delivery Service tab through the PIN code or on the Cart Page at the time of placing the order.

We do not allow modifying the address or PIN CODE of the order once the order is placed. Hence, in such a case, we suggest cancelling the order and placing a new order with the correct address or PIN code.

We usually deliver the order in 5-7 working days from the date it is placed. The expected time taken to dispatch the product is mentioned against each product on the respective product description page.

The best attempt is to deliver the order within the stipulated delivery timeline. However, in certain scenarios order delivery may be delayed due to operational challenges, regional restrictions, bad weather, flight delays, high volume of shipments during sales, or other unprecedented events.

There are three delivery modes for the orders placed on our online platform to cater to customer requirements.

The delivery fee of ₹100 will be charged for an order value equal to or below ₹899/- This amount will be automatically added to your cart at the time of placing the order.

All items (including gift orders) will be shipped with an invoice mentioning the price as per Indian Tax Regulations.

The ordered products will be dispatched through our renowned courier partners. Once products are dispatched, a notification via SMS and email along with the link to track your order will be sent to the customer. The tracking link would become active post 24 hours from the time link is received.

Customer can view the Order status by logging into their SSBeauty App, M-site or website (i.e. Platform) under My Account.

Once the order reaches the destination & is out for delivery, the customer would receive a notification regarding the same. Our logistics partner might also contact the customer through a call on the registered mobile number informing the shipment is out for delivery.

In case of any order having multiple products, there is a possibility of these getting shipped from different locations resulting in multiple consignments being received by the customer. The customer would receive status update and tracking links for each of these consignments and would be notified via email & sms communication.

In the unlikely event that we are unable to deliver the customer’s order completely, we shall cancel the remaining undelivered part of the order and send an email informing the customer about the same. In such cases, the refund of prepaid orders will be processed to the same payment mode that was used while placing the order. The refund for Cash-on-Delivery (COD) orders is not applicable in case of cancellation. The discount coupon code, discount voucher, or any promotional offer used at the time of purchase is non-refundable in case of cancelation.

While receiving the order, if a customer believes that the outer packaging of the order is not in good condition, has been tampered with or damaged, we recommend that the customer should refuse to accept delivery and write to us at customercare@ssbeauty.in informing the same and we shall arrange for a refund of the order at the earliest.

If the customer has accepted the delivery of the order and then noticed that the order is not in good condition, is damaged, defective, incorrect or there is a discrepancy in order delivery, the customer is requested to write to us at customercare@ssbeauty.in informing the same along with the images of package and product within 2 working days from the date of delivery accepted or receipt of delivery SMS or email communication. Any request raised thereafter shall not be accepted.

If a customer claims non-receipt/non-delivery of any order, we request to notify us within 2 working days from the date of receipt of delivery by SMS or email communication, else we shall understand that the order is delivered to and any request raised after that will not be accepted.

In case our courier partner is unable to deliver any order within the stipulated timeframe, the shipment will be returned to us and a refund will be processed in the same payment mode that was used while placing the order. The refund for Cash-on-Delivery (COD) orders is not applicable in case of cancellation. The discount coupon code, discount voucher, or any promotional offer used at the time of purchase is non-refundable in case of cancelation

The courier partner will make two attempts to deliver the order at your delivery address mentioned while placing the order. If the order is still undelivered, the shipment will be returned back to us and a refund will be processed in the same payment mode that was used while placing the order. The refund for Cash-on-Delivery (COD) orders is not applicable in case of cancellation. The discount coupon code, discount voucher, or any promotional offer used at the time of purchase is non-refundable in case of cancelation. In case, if you still wish to have the order, we request you to place a new order.

Terms & Conditions for Coupons & Discounts offered on the Platform

• WELCOME coupon code is applicable only once per customer on the first purchase. It is only applicable on the orders with the minimum purchase of Rs. 2000.
• The coupon code, discount code, and discount applicable is valid only for orders placed on the Website, M-Site or SSBeauty App (i.e. Platform).
• The offers made available by SSBeauty from time to time, can be availed by all active SSBeauty users, subject to eligibility and terms and conditions specified, including those delated hereinbelow.
• Please ensure that the registered email ID and mobile number provided by you is accurate and in use at the time of availing a offer.
• Participation in the offers is purely voluntary.
• The promotions, coupon codes, discounts and discount codes and the offer associated with them may vary from time to time.
• To avail the live coupon discount, please enter the coupon code in the “COUPON CODE” box visible on the cart page during checkout.
• The coupon code, discount code or discount value is not applicable on purchases of Gift Cards, E-Gift cards and First Citizen memberships.
• The coupons may have minimum purchase value with restricted maximum discount. Please check your cart for final coupon discount value applied.
• The coupon discount is applicable on a single transaction/order

The coupon code can be used only once.

• By participating in the promotional offer, the customers shall be deemed to have accepted these Terms and Conditions.
• SSBeauty does not accept the liability for network, computer or software failures of any kind and has no responsibility for lost, delayed or incorrect entries.
• If SSBeauty observes any suspicious, fraudulent or illegal activity directly or indirectly, or observes that the platform is being used to order products not for the customer’s direct usage during or after the offer, then SSBeauty reserves the right to disqualify the customer and any related customer.

Terms & Conditions for Gift Card

• Gift card is a physical card with a pre-loaded shopping value selected by the customer at the time of purchase from either our physical stores or our online platform.
• The holder of the EGV is deemed to be the beneficiary of the voucher. The gift card holds no value until activated. The minimum value for a gift card is Rs.500/- (Rupees five hundred only)
• The gift card is valid for a period of 1 (one) year from the date of issue.
• Gift card can be purchased either from Shoppers Stop store, SSBeauty Store or our online platform SSBEauty.in or Shoppersstop.com
• On purchase of a Gift card from the store the physical card is handed over instantly.
• On purchase of a Gift card from the website, M-site, or App the physical Gift card is dispatched to the delivery address provided by the customer while placing the order. We usually take 5-7 working days to deliver the order.
• Gift card once purchased from any source cannot be cancelled or returned.
• The coupon code, discount value, or promotional offer is not applicable on the purchase of a Gift card.
• Gift card shall not be valid for the purchase of First Citizen Membership, Gift Card or EGV.
• Gift card once used and exhausted cannot be reloaded. Gift cards are not redeemable for cash or credit and cannot be exchanged for a gift voucher.
• If the gift card is lost or stolen, neither will a new card be issued, nor will the money be reimbursed in any manner.
• Gift card can be partly or fully redeemed during purchase at Shoppers Stop or SSBeauty stores across India or online as per requirement before the expiry of the card.
• If the gift card is partly redeemed, then the balance amount continues to remain in the same gift card until used or it expires
• For store purchases, if the invoice value is greater than the gift card value, the customer can pay the balance amount through cash, debit card, credit card, UPI as the case may be.
• For online purchases, if the order value is greater than the gift card value, the customer can pay the balance amount through any other prepaid payment mode such Debit/Credit Card, Net banking, UPI, other wallets etc. Cash-On-Delivery option is not allowed.
• For online purchases, the Gift card can be used by either adding the same to SS Wallet or directly at the time of Check out by selecting GC/EGC as a payment mode.
• SSBeauty shall not be liable or responsible for any unauthorized and/or fraudulent purchase/s made using the card. The holder of the card shall be solely responsible for the safe custody of the card and the credentials mentioned on it.
• SSBeauty or its affiliates are not responsible on account of the beneficiary sharing the Gift card number with any other person or entity and the card getting redeemed on that account
• SSBeauty may ask for valid government identity proof at the time of redeeming the Gift card.
• No duplicate card will be issued by SSBeauty.
• Gift card will be accepted across SSBeauty outlets at its sole discretion and may add or remove an outlet from the list without giving any prior notice.
• SSBeauty makes full efforts to accept Gift cards but on account of any technical or administrative reasons an outlet may refuse to accept the card.
• Gift cards are the property of SSBeauty and should be returned to SSBeauty on request.

Terms & Conditions for E-Gift Voucher (EGV)

• EGV is an Electronic Gift Voucher which when purchased is delivered electronically on the provided email id by the customer.
• EGV is valid for a period of 1 (one) year from the date of issue.
• EGV is issued on the recipient’s email id mentioned by the customer at the time of purchase either at the store or while placing the order online.
• EGV once purchased either from Stores or online cannot be cancelled or returned.
• The coupon code, discount value, or a promotional offer is not applicable to the purchase of EGV.
• The holder of the EGV is deemed to be the beneficiary of the voucher
• EGVis redeemable for products available at all physical SSBeauty Stores and online
• EGV shall not be valid for purchase of First Citizen Membership, Gift Card, EGV, EGV cannot be redeemed or exchanged for cash or credit nor EGV’s be exchanged for a Gift Voucher/Gift Card.
• EGV cannot be exchanged for smaller EGV denominations or cash
• EGVs once used and exhausted cannot be reloaded.
• If an EGV is partly redeemed at stores, then the balance/remaining amount will be refunded in the form of credit note, which will carry a validity of 6 (six) months from the date of issue. The credit note is redeemable at the physical store only.
• Part redemption of EGV is allowed online and the balance amount continues to remain in the same voucher with same validity period till utilised or till it expires. The balance amount in the EGV can be redeemed again on the website or at the store as per the customer’s requirements within validity period.
• For EGV Redeemed at store, if the purchase invoice value is greater than the EGV value, customers can pay the balance amount through Cash, Debit Card, or Credit Card as the case may be.
• For online redemption , if the order value is greater than the EGV value, the customer can pay the balance amount through any other prepaid payment mode such Debit/Credit Card, Netbanking, UPI, other wallets etc. The Cash-On-Delivery option is not allowed.
• For online purchases, the Gift card can be used by either adding the same to SS Wallet or directly at the time of Check out by selecting GC/EGC as a payment mode.If EGV is lost, misplaced, deleted or stolen, neither will a new EGV be issued, nor will the money be refunded in any manner.
• SSBeauty shall not be liable or responsible for any unauthorized and/or fraudulent purchase/s made using this EGV. The holder of this EGV shall be solely responsible for the safe custody of the EGV and the credentials mentioned on it.
• SSBeauty or its affiliates are not responsible on account of the beneficiary sharing the e-Voucher number and the voucher getting redeemed on that account
• SSBeauty may ask for valid government identity proof at the time of redeeming the voucher. No duplicate EGV will be issued.
• Only valid EGVs at the sole discretion of SSBeauty shall be accepted for redemption.
• EGV will be accepted across SSBeauty & Shoppers Stop outlets at its sole discretion and may add or remove an outlet from the list without giving any prior notice.
• SSBeauty makes full efforts to accept EGVs but on account of technical or administrative reasons an outlet may not be able to accept the voucher temporarily. In such scenarios, we might ask the customer to retry the redemption at a later stage. Any EGV dispute should be referred to the entity / person from where the EGV has been received or purchased, the decision of that entity / person shall be final.
• EGVs are the property of SSBeauty to whom it should be returned on request.

Revalidation of Expired SSBeauty Credit Note

The request for revalidation of SSBeauty credit note shall be accepted only after due verification and subject to the applicable terms and conditions at the time of issuance of the credit note. You will need to walk in to the nearest store for assistance.

Terms & Conditions for SS Wallet

SS Wallet is a unique wallet for every customer. SSBeauty at their sole discretion can choose to credit money to a specific customer wallet as a promotion, offer or incentive with a specific validity period. The customer can choose to opt SS Wallet as a mode of Refund while returning the orders. Any money credited in SS Wallet can be used by the customer either at the time of store purchase or at the time of placing the order online.

Also any Gift card & EGV purchased by a customer can be added to SS Wallet for the ease of shopping.

• You may add one or more Gift Cards or E-Gift Vouchers to your SS wallet and redeem the amount across SSBeauty stores and/or online.
• Upon adding the Gift Card or E-Gift voucher to your SS wallet, the validity of the Gift card or E-gift voucher still remains the same i.e. 1 year from the date of issue.
• The redemption of the SS wallet is OTP based.
• Once the wallet is active, you cannot change the mobile number. However, if your contact number is discontinued or not in use any longer, please write to us from your registered email ID informing us about the phone number change along with any one identify proof such as Aadhar card, driving license or PAN card.
• The amount in your SS wallet can be redeemed for the purchase of products from SSBeauty stores across India and www.ssbeauty.in excluding the purchase of First Citizen Membership, Gift Card, EGV,
• Simultaneously, for returns, if you choose the refund mode as the SS wallet, the eligible amount will be refunded into your SS wallet under refund line items and will be valid for a period of 1 (one) year from the date of issue.
• The balance in the SS wallet is not redeemable for cash or credit nor can the balance in the SS wallet be exchanged for an E-gift voucher, Gift card or Gift voucher or money.
• The balance in the SS wallet must be utilized on or before the expiry date. The expiry date of individual line items under SS wallet cannot be extended under any circumstances.
• SS wallet cannot be clubbed with Cash-On-Delivery as the payment mode.
• SSBeauty shall not be liable and responsible for any unauthorized and/or fraudulent purchase/s made using a SS wallet. The holder of SS wallet account shall be solely responsible for the safe custody of the account and the credentials associated with its access and redemption.
• The redemption sequence of individual line items in the SS wallet is based on nearest date of expiry and this cannot be changed.
• SSBeauty reserves the right to amend the Terms & Conditions at its discretion without prior notice.
• By using SS wallets, you agree to all Terms & Conditions for SS wallets.
• Any amount that is earned as promotion, goodwill or service gesture will be credited into your wallet and will carry an expiry date subject to credits condition. If the said credit is not redeemed on or before the stated expiry date, the amount stands lapsed and shall not be eligible for re-validation.

First citizen membership program and its members

Members of the First Citizen Loyalty Program of SSBeauty (the “Program”) can accrue reward points for purchases made at SSBeauty.in within the terms & conditions of use available in all our stores as defined by First Citizen Program.

The First Citizen card shall be automatically linked to your online account or registered email id provided details such as mobile number, email id and date of birth matches the First Citizen database thus enabling customers to redeem or earn the eligible points for online purchases made.

For any change in name, mobile number, address or email id, request you to send a written communication from the registered email id along with any one of the identity proof such as Aadhar card or PAN card at customercare@ssbeauty.in and we shall get the necessary changes done post verification.

Customer are solely responsible for risks associated with activating online reward point redemptions and will not hold SSBeauty or any of its subsidiaries responsible for any loss arising due to such transactions.

You shall not earn any points if order(s)placed with Cash-On-Delivery payment mode.

In case, of any order cancelation or while placing the order through loyalty points as payment mode and there is no order reference number to it, the relevant debited amount shall be credited back to your SS wallet and not to your first citizen account.

SSBeauty reserves the right to cancel/deactivate the membership card of the Program or to withdraw or modify the terms of the Program and the related benefits as communicated to the First Citizen members or non-members under First Citizen Program or any other program or offer of SSBeauty and the related rights, if any provided thereunder.

Financial details

You agree, understand and confirm that the credit/debit card details or other financial details provided by you for availing of services on SSBeauty will be correct and accurate and you shall not use the credit /debit card or financial facility which is not lawfully owned/obtained by you. You also understand that any financial information submitted by you is directly received by our acquiring bank and not stored by SSBeauty. SSBeauty will not be liable for any credit/debit card fraud. The liability for use of a card fraudulently will be on you and the onus to 'prove otherwise' shall be exclusively on you. All information collected by us shall be governed as per our Privacy Policy.

Fraudulent / Declined transactions

SSBeauty and its associated acquiring banks or financial institutions reserve the right to initiate legal proceedings in respect of any fraudulent use of the Platform and any other unlawful acts or acts or omissions in breach of these Terms and Conditions, and reserve the right to recover the cost of goods, collection charges and lawyers’ fees from any person using the Platform fraudulently.

Electronic Communications

When you visit the Platform or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Platform. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Reviews, feedback, submissions

All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to SSBeauty on or by this Platform or otherwise disclosed, submitted or offered in connection with your use of this Platform (collectively, the "Comments") shall be and remain SSBeauty property. Such disclosure, submission or offer of any comments shall constitute an assignment to SSBeauty of all worldwide right, title and interest in all copyrights and other intellectual properties in the Comments. Thus, SSBeauty owns exclusively all such right, title and interest and shall not be limited in any way in its use, commercial or otherwise, of any Comments. SSBeauty will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any Comments you submit for any purpose whatsoever, without restriction and without compensating you in any way and without any liability of any nature whatsoever. SSBeauty is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay you any compensation for any Comments; or (3) to respond to any Comments. You agree that any Comments submitted by you to the Platform will not violate this User Agreement or any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s), and will not cause injury to any person or entity. You further agree that no Comments submitted by you to the Platform will be or contain libellous or otherwise unlawful, threatening, abusive or obscene material, or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of 'spam'.

SSBeauty does not regularly review posted Comments, but does reserve the right (but not the obligation) to monitor and edit or remove any Comments submitted to the Platform. You grant SSBeauty the right to use the name that you submit in connection with any Comments. You agree not to use a false email address, impersonate any person or entity, or otherwise mislead or attempt to mislead Shoppers Stop as to the origin of any Comments you submit. You are and shall remain solely responsible for the content of any Comments you make and you agree to indemnify SSBeauty and its affiliates for all claims resulting from any Comments you submit. SSBeauty and its affiliates take no responsibility and assume no liability for any Comments submitted by you or any third party.

Copyright & Trademark

SSBeauty and its suppliers and licensors expressly reserve all intellectual property rights in all text, programs, products, processes, technology, content and other materials, which appear on this Platform. Access to this Platform does not confer and shall not be considered as conferring upon anyone any license under any of SSBeauty or any third party's intellectual property rights. All rights, including copyright, in this Platform are owned by or licensed to SSBeauty. Any use of this Platform or its contents, including copying or storing it or them in whole or part, other than for your own personal, non- commercial use is prohibited without the permission of SSBeauty. You may not modify, distribute or re-post anything on this Platform for any purpose.

The SSBeauty names and logos and all related product and service names, design marks and slogans are the trademarks or service marks of Shoppers Stop Limited. All other marks are the property of their respective owners. No trademark or service mark license is granted in connection with the materials contained on this Platform. Access to this Platform does not authorize anyone to use any name, logo or mark in any manner.

References on this Platform to any names, marks, products or services of third parties or hypertext links to third party Platform or information are provided solely as a convenience to you and do not in any way constitute or imply endorsement, sponsorship or recommendation of the third party, information, product or service of SSBeauty. SSBeauty is not responsible for the content of any third party Platform and does not make any representations regarding the content or accuracy of material on such Platform. If you decide to link to any such third party Platform, you do so entirely at your own risk.

All materials, including images, text, illustrations, designs, icons, photographs, programs, music clips or downloads, video clips and written and other materials of any nature whatsoever that are part of this Platform (collectively, the 'Contents') are intended solely for personal, non- commercial use. Objectionable material

You understand that by using this Platform or any services provided on the Platform, you may encounter Content that may be deemed by some to be offensive, indecent, or objectionable, which Content may or may not be identified as such. You agree to use the Platform and any service at your sole risk and that to the fullest extent permitted under applicable law, SSBeauty and its affiliates shall have no liability to you for Content that may be deemed offensive, indecent, or objectionable to you.

Indemnity

You agree to defend, indemnify and hold harmless SSBeauty, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney's fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to SSBeauty or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fullfillment of any of your obligations under this User Agreement or arising out of your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this User Agreement.

Termination

This User Agreement is effective unless and until terminated by either you or SSBeauty. You may terminate this User Agreement at any time by informing us in writing through Indian postal system by registered post, that you no longer wish to be associated with this Platform, provided that you discontinue any further use of this Platform.

SSBeauty may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Platform. Such termination will be without any liability to SSBeauty. Upon any termination of the User Agreement by either you or SSBeauty, you must promptly destroy all materials downloaded or otherwise obtained from this Platform, as well as all copies of such materials, whether made under the User Agreement or otherwise. SSBeauty's right to any Comments shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Platform or affect any liability that may have arisen under the User Agreement.

Limitation of liability and disclaimers

The Platform is provided without any warranties or guarantees and in an "As Is" condition. You must bear the risks associated with the use of the Platform.

The Platform provides content from other Internet Platform or resources and while SSBeauty tries to ensure that material included on the Platform is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. SSBeauty will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Platform.

This disclaimer does not apply to any product warranty offered by the manufacturer of the product as specified in the product specifications. This disclaimer constitutes an essential part of this User Agreement.

To the fullest extent permitted under applicable law, SSBeauty or its suppliers shall not be liable for any indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Platform, its services or this User Agreement.

Without prejudice to the generality of the section above, the total liability of SSBeauty to you for all liabilities arising out of this User Agreement be it in tort or contract is limited to the amount charged to you, against the value of the products ordered by you. SSBeauty, its associates and technology partners make no representations or warranties about the accuracy, reliability, completeness, current-ness and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Platform or that the operation of the Platform will be error free and/or uninterrupted. Consequently, SSBeauty assumes no liability whatsoever for any monetary or other damage suffered by you on account of the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Platform; and/or any interruption or errors in the operation of the Platform. By providing your phone number to us, you consent to be contacted by us via phone calls and/or SMS notifications, in case of any transaction messages (i.e.) order, shipment delivery, returns, refund related updates. If your phone number is registered under the National Do Not Call Registry, we will not use your personal information to initiate any promotional phone calls or promotional SMS.

Platform security

You are prohibited from violating or attempting to violate the security of the Platform, including, without limitation:

• Accessing data not intended for you or logging onto a server or an account which you are not authorized to access;
• Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
• Attempting to interfere with service to any other user, host or network, including, without limitation, via means of submitting a virus to the Platform, overloading, 'flooding,' 'spamming', 'mail bombing' or 'crashing;'
• Sending unsolicited email, including promotions and/or advertising of products or services; or Forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting.
• Violations of system or network security may result in civil or criminal liability.

SSBeauty will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this Platform or any activity being conducted on this Platform. You agree, further, not to use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Platform other than the search engine and search agents available from SSBeauty on this Platform and other than generally available third party web browsers (e.g., Netscape Navigator, Microsoft Internet Explorer).

Entire agreement

If any part of this User Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this User Agreement shall continue in effect. Unless otherwise specified herein, this User Agreement constitutes the entire agreement between you and SSBeauty with respect to the SSBeauty Platform/services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and SSBeauty with respect to the SSBeauty Platform/services. SSBeauty's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.

Privacy Policy

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent and we only use your information as described in the Privacy Policy, provided separately. We view protection of your privacy as a very important community principle.

We understand clearly that you and your Information is one of our most important assets. We store and process your Information on computers located in India and abroad that are protected by physical as well as technological security devices. We use third parties to verify and certify our privacy principles. If you object to your Information being transferred or used in this way, please do not use the Platform.

Governing law and jurisdiction

This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Mumbai shall have exclusive jurisdiction in any proceedings arising out of this User Agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by Shoppers Stop Limited and his decision shall be final and binding on the parties hereto. The above arbitration shall be in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Mumbai.

Modification of Terms & Conditions

SSBeauty may at any time modify the User Agreement without any prior notification to you. Subsequent to any modification of the User Agreement, we will inform you of the modifications in the User Agreement via e-mail at the address provided by you while registering on SSBeauty. You can access the latest version of the User Agreement at any given time on SSBeauty. You should regularly review the User Agreement on SSBeauty. In the event the modified User Agreement is not acceptable to you, you should discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified User Agreement.
